Nixon seeks special AG for Blunt email suit Print E-mail

Attorney General Jay Nixon has asked a Cole County judge to appoint a special attorney general to pursue the lawsuit seeking Gov. Matt Blunt's emails.  The judge had ruled a week ago that members of a 3-person investigative team appointed by Nixon did not have standing to pursue the case.

Assistant Attorney General Karen Mitchell wrote a letter Friday to Cole County Circuit Judge Richard Callahan asking him to appoint a special assistant attorney general to pursue the suit. Callahan had ruled last week that Mel Fisher and two others appointed by Nixon to investigate Blunt's emails did not have standing to sue Blunt.

Chet Pleban, the St. Louis lawyer and one of the three investigators, had filed suit in the spring asking for access to the emails.  Blunt has hired former Missouri Supreme Court Judge John Holstein to defend him against the suit. 

In addition to knocking Fisher and Pleban out of the box, Holstein is contending that Nixon cannot obtain Blunt emails without paying about $540,000 in copying costs.
